Arrested & Taken to Jail: Be Careful About What You Say Over the Jail Phone, You Are Being Recorded

Having handled hundreds of criminal cases as a defense attorney in Gainesville, Florida, for more than 25 years, I’ve represented many individuals who literally ruined their potential legal or factual defense by making statements on the phone from the jail.  The purpose of this blog is to spread the word that everything one says from a jail house phone is being recorded.  Courts in Florida have consistently held that one has no expectation of privacy when speaking on the phone at a jail facility, thus recorded jail phone conversations are admissible at trial in criminal cases.

March 5, 1994, Grace Slick Arrested For Aiming Gun At Police Officer - Today In Crime History

On this date, March 5, in the year 1994, former Jefferson Starship lead singer, Grace Slick, was arrested for pointing a firearm at a police officer who was responding to a call that shots had been fired at her house.  Law enforcement officers from the Tiburon California Police Department went to the singer's home after receiving a call at 3:30 a.m. from an inebriated man who said a drunken woman was firing a gun in the home.  When police officers arrived, a man came to the door yelling ''kill me,'' the police reported.  An officer quickly subdued the man.   Grace Slick then came to the door carrying a shotgun and allegedly pointed it at the officers.  Slick was demanding that the officers leave her property as she pointed the firearm at them, police said.

Did George Zimmerman’s Prior Attorneys Do Him A Disservice?

On Tuesday , April 11, 2012, the so-called former attorneys of George Zimmerman announced to the media, and thus the public at large, they were withdrawing from further representation of the man under investigation for the shooting death of Trayvon Martin in Sanford, Florida.

Although attorneys have the ability to withdraw from cases under certain circumstances and although there really wasn’t an actual case to withdraw from as of Tuesday, questions remain regarding the decision to publicly disclose certain matters which may have the potential to negatively impact the defense.

January 18, 1981, Plasmatics’ Wendy O. Williams Arrested For Obscenity - Today In Crime History

On this day, January 28, in the year 1981, Plasmatics band member Wendy O. Williams was arrested on an obscenity charge for allegedly simulating a sexual act with a sledge hammer.  During her physical arrest, Williams was injured and was also charged with battery on a law enforcement officer.

December 21, 1978, Serial Killer John Wayne Gacy Arrested, Later Confesses To 30 Murders, Today In Crime History


On this date, December 21, in the year 1978, serial killer John Wayne Gacy was arrested.  When questioned by law enforcement investigators about having found human remains found in the crawl space at his home, Gacy confessed that he had committed approximately 30 murders since 1972.

December 1, 1955, Rosa Parks Arrested For Refusing To Give Her Bus Seat To A White Person - Today In Crime History

On this date, December 1, in the year 1955, in Montgomery, Alabama, Rosa Parks was arrested for refusing to give up her bus seat to a white passenger.   Her refusal to surrender her seat to the white rider spurred a city-wide boycott of the public transportation system which became known as the Montgomery Bus Boycott.  Her willingness to be arrested and charged with a criminal offense made her an inspiration to other people who recognized the wrongfulness of using the criminal “justice” system to enforce racial segregation.

November 17, 1734 - Newspaper Publisher Arrested for “Seditious Libel” - Today In Crime History

On this day, November 17, in the year 1734, John Peter Zenger was arrested for seditious libel and held in jail for ten months before his case went to trial.  Alexander Hamilton represented him and despite heavy pressure from the colonial Governor's judges, was found not guilty. This case was important for setting a precedent of freedom of the press before America became an independent nation, even in criminal cases.
