BE ALERT: DUI Checkpoint Scheduled on Saturday, January 13, 2018, on West University Avenue in Gainesville, Florida

Be aware that the Gainesville Police Department has announced that GPD and other local law enforcement agencies are conducting a DUI “Roadside Safety” checkpoint this Saturday night, January 13, 2018, in Gainesville, Florida.  This check point will be located in the 3300 block of West University Avenue and conducted between 8:00 pm this Saturday night through 3:00 am Sunday morning.

According to a Gainesville Police Department Facebook post, the check point will serve as an “educational tool and reminder for those driving the roadways of the dangers of driving under the influence of Alcoholic beverages.”  GPD’s Facebook post says that the Florida Highway Patrol and the University of Florida Police Department will also be participating in this checkpoint. Motorist should be aware that the announced ending time of 3:00 am is NOT set in stone.   Most law enforcement operational plans for DUI checkpoints typically provide that a checkpoint “may be extended if needed”.  See, for example, the “Operations Plan” from GPD’s June 26, 2015 checkpoint.  According to the “After-Action Report” issued by GDP following the June 26, 2015 checkpoint, approximately 40 law enforcement officers were involved in that one roadside event.  An estimated 1000 drivers had their freedom of travel interrupted at that checkpoint.  See the “After-Action Report” from GPD’s June 26, 2015 checkpoint.    The June 26, 2015 checkpoint resulted in the issuance of 48 citations and multiple arrests, including three DUI arrests and an arrest for possession of marijuana, according to the after-action report referenced above.

Motorists traveling through this checkpoint should expect delays, vehicle inspections and warrantless searches of their vehicles. You should anticipate that the police officers involved in checkpoints may exercise their power beyond the limits of the constitution.  Motorists wishing to avoid this team of heavily armed police officers might consider avoiding the 3300 block of West University Avenue this Saturday night.

Don’t drive while impaired by alcohol or other drugs.  If impaired, use a designated driver, taxi or Uber.  Be safe, be aware, don't get arrested or harmed.  If you act wisely, hopefully you will not need to hire a criminal defense attorney.
