ALERT: DUI Checkpoint Scheduled on Friday, August 7, 2015, on South West 20th Avenue in Gainesville, Florida

Be aware that WUFT radio is reporting today that the Gainesville Police Department and other local law enforcement agencies are conducting another DUI checkpoint this Friday night, August 7, 2015, in Gainesville, Florida.  This check point will be located in the 4500 block of South West 20th Avenue and will be conducted between 9:00 pm this Friday night and 1:00 am, according to the announcement.

According to the WUFT radio announcement, law enforcement spokesmen are stating that the checkpoint will serve as an "educational" opportunity and reminder of the dangers of driving under the influence of alcoholic beverages.  Other recent local checkpoints have including armed law enforcement officers from the Gainesville Police Department, Alachua County Sheriff's Office, University of Florida Police Department and other local law enforcement agencies.

Motorist should be aware that the announced ending time of 1:00 am is NOT set in stone.  The operational plan for a checkpoint can provide that it “may be extended if needed”.  See, for example, the “Operations Plan” from GPD’s June 26, 2015 checkpoint.  Those who feel that checkpoints are "gestapo like" should review GPD's previous operational plan at the link above.   According to the “After-Action Report” issued by GDP following it’s June 26th checkpoint, approximately 40 named law enforcement officers were involved in that one roadside event.  Approximately 1000 drivers had their freedom of travel interrupted at that checkpoint.  See the “After-Action Report” from GPD’s June 26, 2015 checkpoint.    The June 26th checkpoint resulted in the issuance of 48 citations and multiple arrests, including (but not limited to) three DUI arrests and an arrest for possession of marijuana, according to the after-action report posted above.

Motorists traveling through this checkpoint should expect delays, vehicle inspections and warrantless searches of their vehicles. You should anticipate that the police officers involved in checkpoints may exercise their power beyond the limits of the constitution.  Motorists wishing to avoid this team of heavily officers might consider avoiding the 4500 block of SW 20th Avenue this Friday night. 

Don’t drive while impaired by alcohol or other drugs.  If impaired, use a designated driver, taxi or Uber.  Be safe, be aware, don't get arrested or harmed.  If you act wisely, hopefully you will not need to hire a criminal defense attorney.
